By providing your telephone number and agreeing to receive text messages from any of the Polaris Text Message Services listed below, you agree to these SMS Terms and Conditions.

 

ARBITRATION NOTICE: YOU AGREE THAT DISPUTES BETWEEN YOU AND POLARIS WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. PLEASE SEE THE DISPUTES SECTION OF THESE TERMS FOR EXCEPTIONS TO THIS ARBITRATION NOTICE.

 

For any Polaris Text Message Service you agree to receive, we will send you a confirmation message for that Service. Message frequency may vary. Message and data rates may apply. Reply STOP at any time to opt out from text messages from that Service, and we will send you an automated reply message confirming you have unsubscribed from that Service and will not receive any further messages from that Service. Reply HELP at any time to receive instructions on how to contact our support team for that Service.

 

Polaris Text Message Services Provided:

 

  • RideReady Service Appointments: When scheduling a RideReady vehicle service appointment, you may optionally choose to receive text message updates about your appointment, which will be delivered from 86271 in the United States and 837456 in Canada. Reply STOP to opt out from text message appointment updates. You may optionally choose to opt in again when scheduling a future appointment. Reply HELP to receive options for RideReady support. For questions about these services, please contact RideReady support.

  • RIDE COMMAND+ Check-In Messages (Summer 2023): Owners of certain Polaris off-road vehicles connected with RIDE COMMAND+ may optionally designate check-in contacts and send them location update text messages while riding. Each designated check-in contact will receive an initial text message with the option to confirm/approve before any additional messages are sent. The messages will be delivered from 83962 in the United States and 74332 in Canada. Reply STOP to opt out from all RIDE COMMAND text message notifications, including help alert messages. Check-in contacts may optionally be added again in the future, dependent on a second confirmation/approval. Reply HELP to receive options for RIDE COMMAND support. Polaris is not liable for delayed or undelivered text messages.

 

As always, message and data rates may apply for any messages sent or received. If you have any questions about your text plan or data plan, please contact your wireless provider.

 

Participating Tier 1 carriers in the United States include AT&T, Sprint/Boost/Virgin, T-Mobile, MetroPCS, Verizon Wireless. Participating mobile phone carriers in Canada include Aliant Mobility, Bell Mobility, Eastlink, Fido, Mobilicity, MTS, NorthernTel Mobility, Rogers Wireless, SaskTel Mobility, Telebec Mobilite, TELUS Mobility, Videotron, Virgin Mobile Canada, Freedom Mobile. No carrier is liable for delayed or undelivered messages. Supporting mobile carriers may change without notice, and each service outlined above may be limited to specific carriers.

Disputes


You agree that except as specified herein, any disputes directly or indirectly arising out of or relating to these Terms or the Polaris Text Message Services (“Claims”) shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota. You hereby irrevocably consent to such venue and to the exclusive jurisdiction of any such court over any Claims. You agree to commence any Claims within one (1) year after the Claim arises.

 

The foregoing notwithstanding, you and Polaris each agree to submit any disputes directly or indirectly arising out of or relating to these Terms or the Polaris Text Message Services exclusively to final and binding arbitration taking place in Hennepin County, Minnesota. If this location is not convenient for you, please notify us and we will work with you to determine a mutually convenient location or arrange for remote hearings. Any disagreements regarding the location or format of arbitration hearings will be settled by the arbitrator.

 

You agree and acknowledge that you and Polaris are each waiving the right to a trial by jury or to bring or to participate as a plaintiff or class member in any class, purported class, collective, coordinated, consolidated, or representative proceeding. The Federal Arbitration Act applies to these Terms.

 

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to Legal Department, Litigation Counsel, Polaris Inc., 2100 Highway 55, Medina, MN 55340. The arbitration will be conducted under the rules of the American Arbitration Association (“AAA”), including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at http://www.adr.org or by calling 1-800-778-7879. Payment of all fees will be governed by the AAA’s rules. To the extent the filing fee for the arbitration exceeds the cost of filing a lawsuit, Polaris will pay the additional cost. The parties understand that, in some instances, the costs of arbitration could exceed the costs of litigation and that the right to discovery may be more limited in arbitration than in court. You may choose to have the arbitration conducted by telephone or based on written submissions.

 

The arbitrator(s) shall have no authority to award punitive, consequential or other damages not measured by the prevailing party’s actual damages in any arbitration initiated under this section, except as may be required by statute.

 

Arbitration is not required for the following claims, which may be brought in court: (a) disputes related to intellectual property (like copyrights and trademarks), (b) Polaris claims related to unauthorized access, use of, or interaction with the Sites, (c) any claims you may have that qualify for small claims court, and (d) claims relating to the scope and enforceability of this arbitration provision.
