“2024 70 Years of Creating Memories” Contest (the “Contest”)
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN.
DATES OF CONTEST: The Contest begins at 12:00 a.m. Eastern Standard Time (“ET”) on August 1, 2024 and ends at 11:59 p.m. ET on September 30, 2024 (“Contest Period”). For purposes of these Official Rules, all times given are in Eastern Standard Time (“ET”).
SPONSOR: Polaris Industries Inc., 2100 Highway 55, Medina, MN 55340.
ELIGIBILITY: The Contest is open to snowmobile owners that are legal permanent residents located within the fifty (50) United States or the District of Columbia who are eighteen (18) years of age or older as of the date of submission (the “Entrant”). Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of Sponsor and its respective parent companies, divisions, affiliates, subsidiaries, distributors, advertising and Contest agencies, and any others engaged in the development, production, execution or distribution of this Contest, including but not limited to National Sweepstakes Company, LLC, Caffelli (the “Independent Administrator”), and the entities supplying the prizes herein (all of the aforementioned collectively referred to as the “Contest Entities”), are not eligible to participate. Contest is subject to all federal, state, and local laws and regulations, without regard to conflict of law provisions. Contest is void in Hawaii, Puerto Rico, US territories and possessions located outside of the forty-eight (48) contiguous United States, Alaska, and the District of Columbia and wherever else restricted or prohibited by law. By entering this Contest, the Entrant indicates their full and unconditional agreement to and acceptance of these Official Rules and the decision of the Sponsor, which are final and binding in all respects. Winning is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: Visit www.polaris.com/snowmobiles70th (the “Website”) and complete the online entry form on the Website landing page, submit a written statement about how much you love your Polaris Snowmobile and upload a photo of you with your snowmobile (not required) (the “Submission”). Entrant must complete the online entry form in its entirety to include name, address, phone number, and email address. Written statement must be 250 characters or more. Upon completing the Submission, click the “Enter Now” button to receive one (1) Submission into the Contest. Entrant’s address will determine which region the Entrant will be entered into the respective judging region.
Photos should be no larger than 10MB and must be submitted in JPG format. Entrant should only submit photos of themselves and their equipment and not contain any third-party persons unless third party persons have signed a release form. Entrant may be asked by Sponsor to provide the third-party release form for any advertising/promotional purposes in connection with the Contest. Any photo that contains third party persons will be disqualified if a third-party release is unable to be provided.
There is a limit of one (1) Submission per Entrant for the Contest.
Neither Sponsor, nor any other Contest Entity, are responsible for any Submission that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions or any other reason, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, Submissions not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.
By submitting a Submission, Entrants and Grand Prize Winner grant Sponsor and their affiliated companies worldwide, non-exclusive, perpetual, irrevocable, royalty-free, unconditional, and fully paid-up rights to publicly perform, display, broadcast, or transmit the Submission and/or the makeover (to include any videos, photos or written works of the makeover), in whole or in part, for promotion and marketing purposes worldwide in any and all forms of media, whether now know or hereafter devised, and to distribute (directly or indirectly through multiple tiers) the Submission and/or the makeover to Sponsor affiliates, its marketing agencies, and to third parties for these purposes. Submission must be truthful in all respects. Entrants and Grand Prize Winner further agree and warrant that they may not submit any Submission that is known or that should be known at the time by the Entrant that (a) is false, inaccurate, or misleading; (b) infringes on any third party’s copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; (c) violates any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); or (d) is or may reasonably be considered defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership, or corporation.
NON-QUALIFYING SUBMISSIONS: Submissions (a) containing general obscene, lewd, crude, vulgar, profane, defamatory or inappropriate text, including acts of violence or acts that appear to cause harm; (b) containing other offensive content and/or any content expressing explicit, graphic or excessive indecent content that is or could be considered inappropriate, unsuitable, or offensive; (c) containing and displaying third-party brands prominently and intentionally or any materials that violate or infringe (or may infringe) any copyright (including, without limitation, music or artistic work), trademark, logo, or other mark that identifies a brand, entity or other proprietary right of any person living or deceased, including but not limited to rights of privacy or publicity or portrayal in a false light; or (d) otherwise violate these Official Rules, as determined by Sponsor, in their sole discretion, will be disqualified from the Contest. Sponsor reserves the right to disqualify a Submission with offensive content or material that it feels inappropriate in any way. Each Submission submitted must be an original work, never previously published, manufactured or produced. Late Submissions or Submissions sent via any other method than those stated above will not be accepted.
JUDGING: On or about October 1, 2024, a Sponsor representative will judge all eligible Submissions received for each of two regions 1) Mountain and 2) Flatland during the Contest Period based on the following criteria:

Creativity:10%
Grammar:10%
Spirit of the Brand: 30%
History with Brand/ 70 years of Polaris Snow 40%
The Submission that receives the highest score in each region will be deemed the Grand Prize Winner. In the event of a tie, the Sponsor will re-judge any tied Submissions to determine the Grand Prize Winner. Judging of tied Submissions will be based upon the same criteria as outlined above.
Sponsor may perform as many ‘tiebreakers’ needed in order to determine the Grand Prize Winner.
The judging of Submissions will be conducted under supervision of the Sponsor and Independent Administrator, whose decisions are based upon their sole interpretation of these Official Rules and are final and binding in all respects.
Sponsor reserves the right not to award a prize if, in its sole discretion, it receives an insufficient number of eligible and qualified Submissions. Prize awards are subject to verification of eligibility and compliance with the terms of these Official Rules.
PRIZES: Each Grand Prize Winner will receive a trip to ride with Chris Burandt or Levi LaVallee to include: i) $1,500 Gift Card to be used towards travel to the event, and ii) the ride with Chris Burandt or Levi LaVallee (determined by the region) (the “Grand Prize”). Total approximate retail value (“ARV”) of each Grand Prize is $1,500.
Grand Prize details, including dates are at Sponsor’s discretion. Grand Prize must be taken on the dates determined by the event. In the event the Grand Prize Winner is unable to attend the event on the dates determined by the Sponsor the Grand Prize Winner will forfeit their right to the Grand Prize and no compensation will be awarded. Trip, events and experiences, travel and lodging elements selected by Sponsor may be subject to change due to impracticability or unavailability, or for any other reason as determined necessary by Sponsor or its designee, and are subject to any and all applicable health and safety protocols (which may be dictated by provider/location policies and/or state and/or local government requirements – all of which are subject to change at any time, including as the result of the COVID-19 pandemic). Tickets, VIP experiences and certificates if any, are subject to the terms and conditions of issuer and will not be replaced by Sponsor if lost, stolen, misplaced, damaged or destroyed. Grand Prize ARV may vary, depending on the point, date and time of departure. Any difference between ARV and actual value will not be awarded as cash or otherwise. Grand Prize Winner must be accepted as a whole or will be forfeited in its entirety. Grand Prize Winner will be responsible for all meals, transportation, excursions, tips or gratuities, fuel, parking, beverages, telephone calls, overages, baggage fees, extras and any other incidental costs or expenses not specifically stated herein as being included. Grand Prize conditions may be added or modified by Sponsor or its designee. Contest Entities are not responsible for any changes of any element of the Grand Prize, nor are they liable for any expenses incurred as a consequence of flight/event changes, cancellation or delays. Travel is subject to capacity controls, availability, and certain other restrictions, all of which are subject to change. Any unclaimed and/or unused element of the Grand Prize, or any element thereof, will remain the property of Sponsor or its designee. The Grand Prize restrictions/conditions stated herein are not all-inclusive and the described above may be subject to additional restrictions/conditions, which may be stated in the Affidavit (as defined herein), and/or other travel or release documents. Grand Prize Winner later found ineligible or non-compliant will be immediately required to return and forfeit any prize awarded. In the event Grand Prize Winner and/or any guest engages in behavior that, as determined by Sponsor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, illegal or that is intended to annoy, abuse, threaten or harass any other person, or may cause harm, property damage or any other loss, Sponsor reserves the right to terminate early, in whole or in part, and to send the Grand Prize Winner (and any guest) home with no further compensation.
Grand Prize will be forfeited if Grand Prize Winner is unable to attend on the date determined by Sponsor. Any Grand Prize activities, experiences or other elements may be selected or substituted by Sponsor (or its authorized representative) in its sole and absolute discretion. Grand Prize has no cash value and any unused portion of the Grand Prize will not be awarded as cash or otherwise. No transfer, assignment or substitution of the Grand Prize (in whole or in part), except that Sponsor reserves the right to substitute a prize of equal or greater value. Products, tickets, or any other element received as part of the Grand Prize may not be resold, auctioned, bartered, or placed into any other unauthorized channels of distribution. Any prize pictured in advertising or promotional materials is for illustrative purposes only and may not be the actual prize awarded.
GRAND PRIZE RESTRICTIONS: No transfer or substitution of the Grand Prize is allowed except at the sole discretion of the Sponsor. Grand Prize Winner is required to comply with any and all applicable federal, state, and local laws, rules and regulations. The value of the Grand Prize is taxable as income and the Grand Prize Winner is solely responsible for all matters relating to the Grand Prize, including, but not limited to all applicable federal, state, and local taxes that become due with respect to the Grand Prize. Sponsor reserves the right to substitute a prize of equal or greater value if any part of the Grand Prize becomes unavailable due to reasons beyond the control of the Sponsor. Sponsor will not replace any lost or stolen portion of the Grand Prize. No more than the one (1) Grand Prize per region as set forth in these Official Rules will be awarded. Grand Prize Winner agrees that the prize is being provided “as is,” and the Released Parties (as defined in the “NO LIABILITY” section below) make no warranty, representation or guarantee regarding the Prize, including but not limited to its quality, condition, merchantability or fitness for a particular purpose. Contest Entities are not responsible for any changes of any element of the prize, nor are they liable for any expenses incurred.
NOTIFICATION: POTENTIAL GRAND PRIZE WINNER WILL BE NOTIFIED WITHIN SEVEN (7) DAYS OF VERIFICATION BY A SPONSOR REPRESENTATIVE VIA EMAIL (THE “NOTIFICATION”). Potential Grand Prize Winner must respond to the Notification within the date and time frame indicated. In the event that: (a) the potential Grand Prize Winner fails to respond to the Notification the date and time frame indicated; (b) the potential Grand Prize Winner fails to supply the Required Documents (as defined in the “PRIZE CLAIMS” section below); (c) any Notification is returned as undeliverable; and/or (d) it is determined by the Sponsor, in their sole discretion, that the potential Grand Prize Winner is not eligible in accordance with these Official Rules, such potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected based upon the Entrant whose Submission received the next highest score.
PRIZE CLAIMS: Grand Prize Winner must complete in its entirety and sign an Affidavit of Eligibility/Liability/Public Release Form (the “Release”) or any additional paperwork required by Sponsor along with an IRS Form W-9, (collectively the “Required Paperwork”). If the Grand Prize Winner fails to sign and return the Required Paperwork within the required time frame, the Grand Prize Winner forfeits their right to the Grand Prize and an alternate Grand Prize Winner will be selected based upon the Entrant whose Submission received the next highest score. The value of the Grand Prize may be taxable as income and the Grand Prize Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state, and local taxes that become due with respect to the value of the Grand Prize. Sponsor (or a third party acting on its behalf) must report the value of the Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099.
Grand Prize Winner consents to use of their name, likeness, biographical information, and voice (or any derivation thereof) in advertising worldwide without additional compensation (TN residents will not be required to sign a publicity release as a condition of winning a prize).
GENERAL: All federal, state and local taxes on the Grand Prize are the sole responsibility of the Grand Prize Winner, if applicable. By participating in this Contest, each Entrant agrees to abide by and be bound by these Official Rules and the decisions of the Sponsor which shall be final in all respects relating to the Contest, including without limitation, the interpretation of these Official Rules. Sponsor, its agents, licensees, subsidiaries, affiliates, advertising agencies, promotional agencies and suppliers and any other individual or company involved in the development or execution of the Contest, and each of their respective directors, officers, shareholders and employees are not responsible and shall not be liable for; [a] electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction; [b] unauthorized access to or alterations of Submission materials; [c] technical, network, telephone equipment, electronic, computer, hardware or software malfunctions; or [d] limitations of any kind or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor and its agents are not responsible for lost, late, incomplete, incorrect, damaged, misdirected, or any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted. Sponsor may prohibit an Entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Independent Administrator. Submissions which contain false information, are incomplete, inaccurate or are otherwise forged, defective, or made outside authorized channels, including those which have failed due to malfunction or failure of phones, phone lines, telephone systems or networks, server, providers, computer equipment, software or any combination thereof of any kind, any human error or otherwise, shall be void. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS. If, for any reason whatsoever, this Contest, in Sponsor’s sole opinion, is not capable of running as planned, including, but not limited to, by reason of infection by computer virus, tampering, fraud, technical failures, or any other cause which, in the Sponsor’s sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest and limit Submissions to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. Notice of such action will be posted on the Website.
DISPUTES: THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF NEW YORK WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, each Entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York, having jurisdiction over the parties and the subject matter. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and entrant further waives all rights to have damages multiplied or increased.
PERSONAL INFORMATION. By entering this Contest, each Entrant expressly consents to the storing, sharing, and use of the personal information submitted with their Submission by Sponsor and its agents and/or representatives, in accordance with Sponsor’s Privacy Policy. All entry and other information submitted may be used for advertising, trade, and marketing purposes both by Sponsor and authorized third parties in accordance with Sponsor’s privacy policy, available at https://www.polaris.com/en-us/privacy/.
NO LIABILITY: By participating, Entrants agree to release, discharge, indemnify and hold harmless the Sponsor and its agents, and each and all of the Contest Entities from and against any claims made related in any way to the operation of the Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity, in the Contest and the display or distribution in any way of the Submission, or any claims based on publicity rights, defamation or invasion of privacy or merchandise delivery.

This Contest shall not be published without permission of the Sponsor.
